Well, I'd move this to the archive, if it weren't for something I'm wondering about. From what I understand (and I could be wrong) we are allowed to use TES3 textures as long as we tweak them, then they are ours... But we are not allowed to use TES3 models and tweak them because they are still Beths.
So the question is, are we allowed to use TES3 models and TES3 textures and change them, or are we allowed neither? Or one and not the other? |

neither I belive... but as long as you dont distibute them Beth cant do a thing.
a person on ESF got warning and tread locked because he used the Morrowind Texture.. (not sure if he tweaked it or not) and I asumme asset mean all their things... unsept the writen stuff as scripts and books and the written dialogue..

Neither. They are both assets of TES3 and aren't allowed in OB.

But if they are custom models/textures from TES3 designed as modder's resources, then we should be able to use them?

Well, yeah. If they're not retextures of original models. Anything that was customized (as long as it's fully customized and not just a tweaked texture/model) can be used, as it was created by a player and not Bethsoft or another company.

I rely heavily on Morrowind retexture packs, like Morrowind Visual Pack and Vibrant Morrowind and others. Sometimes it's obvious that some of those textures were based on the originals, and have been scaled up and refined using various techniques. It's particularly true of complex textures with designs or patterns that are very hard to emulate without actually creating a texture from scratch. I mean, wood is wood, but an ornate pattern on a ceramic bowl can't be replaced quite as easily.
But I don't think Bethesda sees those tweaked textures as their assets, because they should have said something about it if they did. Appended a message that we're not allowed to use textures based on their textures in Oblivion mods. But either way I see them as placeholders, because they're for the most part not very good for Oblivion use, and should preferrably be remade in high resolution but still not lose the design - which is probably a lot of work for the texturer who would take it on, but still. I'm sure it'll work itself out in time, and should Bethesda voice concerns I can easily add worse placeholders. Regarding the other thing, I believe Bethesda's intent is to prohibit us modders from distributing stuff from their commercial mods. I imagine that means they have to phrase themselves in a certain way, like forbidding us from distributing Oblivion assets for Oblivion mods altogether. I highly doubt they would actively combat Oblivion retexture mods (that doesn't involve commercial mod assets).
